Actually, libel is an interesting thing. The truth, of course, is an absolute defense. But to prove libel, you have to prove that the person either knew that his comments were false or "recklessly" failed to investigate the facts. See NY Times v. Sullivan 376 U.S. 254 (1964) which applied the term "actual malice" (although the comment need not be an intentional lie). However, as in every civil case, the plaintiff must not only prove conduct but must also prove actual injury. Kanye's "Bush hates black people", for example, could be slander if Kanye knew it was untrue or "recklessly" failed to investigate whether or not it was true. BUT it would only be actionable if Bush could prove that he was suffered monetary harm.

An interesting result is that comments that are so outrageous that no reasonable person could believe them, there is legally no libel. So your example of an accusation that Obama is a convicted pedophile unfit for office would very likely NOT be considered libel because Obama would not suffer harm to his reputation as the claim is so outrageous that no reasonable person would believe it. This is precisely what happened in Hustler Magazine v. Jerry Falwell. Falwell sued Hustler and Larry Flynt over a satirical "interview" in which Falwell admitted to being drunk and having sex with animals and his mother. The interview was so obviously false that Falwell could not have been injured because noone would have believed the story.

Here, Saule's ridiculous comment about Pres. Obama "going after our children" is limited to eha viewers, none of whom take Saule serious on any issue, let alone a commment like this. Saule need not fear being sued for libel.
Lol poor Saul. Everyone is picking on him.

I've got a radical idea...instead of merely taking politics out of school, why don't we take the entire government out of it?

And a radical question...since when is education an interstate issue? You know, the only issues the federal government is supposed to deal with according to the Constitution (see section 8 and amendment 10)?

It saddens me that the discussion is limited to whether or not politics should be in school when we really should be asking if the government itself should be involved. Ugh.

Not me. I was just acting as his lawyer, defending him from the potential lawsuit someone alluded to.

I absolutely agree with you on this one Jacquesne. The question may seem radical, but the more radical issue was the expansion of the federal government into state matters.

I was more concerned about this before the fact than afterwards. Before I knew what he was going to say I was concerned we might be starting the indoctrination and training of a new Hitler Youth. I was very glad to see there was no political message I am aware of.

What I really view as a "duh" on this, however, is that his main message was "stay in school." The audience was ELEMENTARY school students. When is the last time you ran into a 3rd grade dropout?

When was the like time you ran into a 3rd grade h.e.r.o.i.n addict? (I'm sure it's out there) Yet they have the D.A.R.E program at that age.

They preach that at a young age. I remember when I was in elementary they had that, "Be cool, stay in school" thing. I think that their thinking is to condition the kids at a young age so by the time they get to high school it isn't as big of a problem.

[quote=Work_in_Progress;750088]Figures it came from Fox "news. "

Yeah, Fox is anything but a real "news" channel. They are screaming, screeching nuts in my opinion. I use to watch Fox because you could get divergent views. Now they are so upset that we have this president that everytime any of them speak they sound so angry I'm expecting their heads to pop off at any minute.

And how is it you figure President Obama is responsible for this?

He is being blamed for everything - even things he had nothing to do with.

And everyone who doesn't agree with you is an idiot? Wow. Just wow.

You got one thing right - though President Obama may not always be right and may make mistakes along the way (which he at least was man enough to admit was a distinct possibility from the get-go), he probably is a genius.

No president, or any politician for that matter, is always right. Never. I don't care how smart they are. And they all make mistakes. But I agree - when he does something wrong he is the first one to admit and try to correct his mistakes. I wonder why people don't pay attention to that??? They are fighting against him just because of who he is. If he says up, they say down. If he says blue, they say green....all just to be disagreeable. It's pretty pathetic if you ask me.

And after the bumbling idiot we had in there for the past 8 years, some republicans just can stand that.

They can't stand it. The bad part is they don't want him to succeed. That's crazy to me because if he fails WE ALL FAIL!

He is not "going after" our school children. Education is important to him and he seems to want children to understand the importance of school. Again, the people who are attacking him are doing it just to be disagreeable.

Again if they would just stop disagreeing with EVERYTHING this man says I could take them more seriously. If they would stop screaming and actually make some points that made sense I could take them more seriously.

Thus far I am disappointed with Obama ... He has pushed through stimulus bills that I am against ... Bailouts that I am against ... And 'Health Care Reform' (aka single payer plan in 10 years) that will put me out of work ... Closing GITMO may be a good idea, but he hasn't done that yet ...

As far as the 'going after children comment' ... Seeing as how the video came out around his speech to kids (which initially had an assignment asking kids how they could help President Obama) ... I can see the concern. And the trouble is that I have to search for things that I agree with him on, so it becomes almost a Pavlovian (?sp) response 'Obama says something, I disagree' (with a once in a blue moon correction changing it to an agreement and offering an apology)

One might argue that it isn't just Obama, it's also congress et al ... But his administration is running things so it falls on his shoulders.

I still don't seen much if any change from Bush policy wise. He was supposed to be the anti war candidate. That hasn't happened we are even expanding into Pakistan and threatening Iran. He said he wouldn't use signing statements he lied about that. He was against mandated health insurance. He went back on that. I could go on and on.

He's just another corporatist.
