We should hope she's not the best candidate "for the Democrats" ... she's being nominated for the Supreme Court, which we don't want ruled by politics (even though it will certainly have some influence). Instead, we should consider whether she's a good candidate "for the nation".

Applying the situation solely to one of "intelligence" would be erroneous though ... while I do not like the need for such measures, the system was (and still is) biased against racial and ethnic minorities. In a recent study, it was found that white applicants with a felony conviction were more likely to receive a call-back for a job than black applicants without a felony conviction (the disparity was even more significant when like convictions were compared) ... this has a significant impact on job opportunity - affecting income, which then affects educational opportunity for children ... serving to reinforce stereotypes (such as intellectual ability) and continuing the cycle of racial discrimination.

We have to break the cycle somehow.

Well I guess the NeoCon George Hoover Bush gave us a few judges. So now we all [some of us] gotta hang on when we get an extremist from the other side. Out of all the Puerto Rican judges, I still say elect Judge Penny. I think she's a Boricua. {Puerto Rican.}

Personally I think B'lanna Torres would do. Heck she's half Klingon...and cute.

On the surface, if her ruling had been upheld, it might look like a victory for minorities. And that would be incorrect.

Firefighter promotional exams are not slanted towards any group. It's how well you know city policy, the job you hope to get, and dealing with command. The information is there for any who wish to study it. One of the New Haven FF's is dyslexic and paid someone $1000 to read the material onto tapes so he could study better.

If these results had been thrown out, wouldn't that say to everyone, that African Americans need help to stand on an equal footing intellectually with whites and Hispanics ?

If a new test had been devised and somehow "curved" to help African Americans score better and get promoted, who in the department would believe they deserved it ? Would you want the best qualified officer looking after you in a life threatening situation, or the one who wasn't even in the top 20 of the original test ? Anyone promoted under such a cloud would not have the respect of his fellow firefighters.

The moral of the story...work hard, study hard, and no matter your race, that will determine how well you score.

What's really sad is that 4 Supreme Court members felt it was ok to discriminate against people because of their race.

As Chief Justice John Roberts said in another ruling: (Loosely quoted)

"The way to stop discrimination against people because of their race is to stop discriminating against people because of their race."

Simple concept.
When you want your pound of flesh like so many today do it's the only concept you understand and with some people getting that pound of flesh racial tension will only get worse and not better...we already live in a nation where a supreme court nominee can say that she is more qualified to make judgements as a Hispanic woman than a white man would be..a blatantly racist statement that is not supposed to have any place in America today.

I am glad that the promotional exams are knowledge based because that makes a lot of sense & is quantifiable. The tests for entrance onto the force are not so much. They profile for personality which is why most every test is held up due to lawsuits.

About the case in New Haven. I don't have enough info about it to make a judgement... & I don't have any interest in researching it. If I were to judge from the soundbites that I have heard then I would clearly have to say that the test should be upheld & promotions given. There could be more to it than that though.
