In the wake of the MBTA firing whatever the name of the driver was for texting while driving and causing an accident that injured 50, the MBTA has said it is going to be firing all those caught using cell phones and is banning the possession of cell phones while working for all. The union is now fighting this because they feel the penalty for not following the rules is too tough. Really break a rule twice and you are fired. Why is that too tough?

Dont know the facts ..but ..if a public transport driver was texting whilst driving and subsequently caused suffering to others he deserves to be fired.. period... as for "Union in the wrong" ..dont know the facts ..so cannot commnet on this situation..what I WILL commnet on is that (a) unions .like all political organisations are run by people who often seek power more than they seek to serve their members ..(b) the corporate establishment is now so overpowering that unions have lost thier ground ..so we desparately need strong unions to represent ordinary people .. however..a tough nut to crack due to the nature of power itself ...

Texting Boston Trolley Driver Fired After Crash as MBTA Union Challenges Cell Phone Ban
Also Thursday, the MBTA's main labor union reversed course and decided to challenge the transit agency's new ban on the possession or use of cell phones while working.
The Boston Carmen's Union said in a letter Thursday that "the rule is unreasonable under the contract" with subway and trolley drivers. The members said they support some change in policy, but only after it has been negotiated.
Under the new policy, operators caught talking or text-messaging on a cell phone will be discharged immediately.
There will be a 10-day suspension for a first offense of carrying a phone or PDA. A second offense will be punished by a 30-day suspension with recommendation for firing.
As I read that, there are two separate issues:
- (banning) possession of a cell phone while working
- (discharge for) using a cell phone while operating

I've never had one myself, but a lot of people consider cell phones to be a necessity these days. For one thing, it is the way parents are reached by their children's schools. Perhaps the employer's radio communication system would fill this function. Nonetheless, operators do have breaks and mealtimes during their shifts when having a cell phone might be important to them. Public pay phones are short supply these days.

I think the union has a very strong case when it comes to possession, if that is what it is saying: there is no genuine basis for any ban or disciplinary action for merely possessing a cell phone on the job.

Talking, let alone texting, while operating is a completely different matter. It is tantamount to careless driving. Wise jurisdictions are outlawing it for everyone.

And it should not matter whether an operator causes damage or harm while doing that or not (any more than it matters whether a drunk driver actually hurts anyone or damages anything -- or should matter whether anyone is hurt when a firearm owner stores a firearm insecurely, for example). That's just rolling the dice; it's okay to do it, but if anything bad happens, you're in trouble. Gambling with the public's safety isn't wise.

Anyhow, I don't think the union is fighting the ban on / discharge for texting/talking; it's fighting the ban of possessing cell phones while working.

That doesn't put it in the wrong in my eyes. If I'm misinterpreting its position, I'd be in disagreement with it when it comes to using cell phones while operating a vehicle.

no this is not a case of the unions being wron but an example of the system working like it is supose to. We do live in a confransasunal socuity and thoes who have to make a decision need to hear all facts and points of view. This is why we have freedom of press and speach. This is why people who want to do a way with Fox news are in the wrong, they only want there verson heard. this is why scienctist who censror other becuse theydon't suport globle worming, or evelotion are in the wrong. Also why the use of the invalid arguments (circular thinking, red herring, eather or,)are so bad for the country. And don't forget it is the members of the local union, the people who work to the co. who will make the finel decision.
