I have to admit to seeming inconsistent on this issue.

I think that when dealing with a business, you, a consumer, are interacting with an enterprise whose sophisticated practices were developed by individuals with the sole aim of maximizing profits. It is essentially impossible for you to negotiate the terms of consumer “contracts of adhesion.” Since it would not hesitate to impose on you all the “gotcha” clauses, you owe it to fairness to do the same.

When dealing with the (putative) player, you are dealing with another individual, with whom you can negotiate and interact on a level playing field. You don’t know if someone is a “player,” a guy with little experience, or some poor bloke who read some “pick-up lines” off the internet. No matter who he is, though, you can interact with him from an inherently fair position.

My view on this is colored by my premise that these “players” are not in fact nearly so common as their mythological standing indicates.
