Last week, Monday I think it was, a guy I had previously dated approached me and said he's not busy like he was (custody issues) and still wanted to go out. I said "sure" and made sure he still had my number.

I have yet to hear anything. I would thinking asking in person would be harder then a phone call...a text...anything? Just saw him at work (different companies, same building), he was on the phone and smiled at me.

I'm not all worked up over it, it's just mind boggling.

Some guys - eh, A LOT of guys are all talk. He probably blurted out that he would call when he saw you and really didn't mean it. I would bet he really is still busy with the custody or other busy business and doesn't have time to give you the attention you deserve.

Eh, if he is honestly a busy guy perhaps he truly forgot. On a busy week I can forget even the simplest things and rely on my daily calendar to remind me of conference calls and other appointments. If I meet a woman and tell her I am going to call her, it is likely I don't put that on my calendar so I might forget. Sucks for you, but I am sure no harm was meant.

Okay...maybe he's a doofus and truly forgot. Kind of makes you wonder what he'd forget once he got comfortable in a relationship. So I see that he smiled at you today and that should have been enough to jar his memory. If not then what?

I'd say that he is/was tryin to keep his opitions open an decided to
make sure that you were still interested in him, I'd think that he will call but it might be a lot later, like after all his opitions have run out.
Some guys are jus like that.
I'd also say forget him, if he was really interested in you then he'd make a way of comunicating with you, and/or setting up a get together sooner rather than later.
If he's gonna wait for ever to call or contact you now how would it be later on? As in he might jus be in it for a 'booty call' type of thing.
Move on to bigger an better things is my advice.

Hard to tell. But I'm not expecting or waiting for him to ask me out. If he does, I'll go if I'm free. If not, oh well.

just walk up to him and casually say " oh, btw, what's your name, rank and phone number?"
